In the cause presented by appeal numbered 3894, the trial court sitting without a jury found defendant guilty of the crime of grand theft and denied his motion for a new trial, as well as his application for probation. Appeal numbered 3893 arises out of a prior conviction of the crime of burglary, wherein proceedings were suspended and defendant was placed on probation for a period of fifteen years from and after July 2, 1938. By reason of defendants conviction of the crime of grand theft (Appeal 3894), the court found he had violated the terms of his probation, and revoked the same and entered judgment for burglary (Appeal 3893), the sentences imposed in the two causes to run concurrently.
